Gifted Youth Terms and Conditions

The following Terms and Conditions apply to all lesson agreements made between “Gifted Youth Music and Arts Studio” and its students and the parents / caregivers of its students (“the pupil”) and include references to Gifted Youth’s program’s pupils. The Terms and Conditions described below may seem relatively strict but have been discussed at length amongst The Gifted Youth leadership team with the endeavor of making them as fair as possible for both client and provider. Gifted Youth is an LLC that functions with minimal margins, such lines in the sand have had to be drawn and are not a reflection of how awesome the majority of Gifted Youth’s Families are. They are a reflection of the small margin of people that have taken advantage and never paid for services rendered that jeopardize the livelihood of our instructors and managers. We try to approach each individual case in good faith with an open ear and we hope that you will also approach us in the same manner. There will be times that the terms and conditions are more in favor of Gifted Youth but there are also other times that they are more in favor of the student/caregiver.
1. Teaching weeks and Holidays
1a. Teaching weeks at Gifted Youth roughly adhere to the Local School and their teaching days, However, When there is a holiday, a longer month, or a shorter month the subscription price remains the same as some months are longer and some are shorter. The missed lesson will likely be made in the longer months.
2. Communications
2a. All correspondence is sent out to the parent by text and/or email. If this causes a problem, please let Gifted Youth know. 2b. It is the responsibility of the pupil and parent to make Gifted Youth aware of any changes to their contact details. Gifted Youth will not be held responsible for any missed communications, late / overdue payments, missed lessons, etc. if this is due to incorrect contact information. 2c. Due to the size of our student roll, most of Gifted Youth’s communication is done via bulk delivery services through email, therefore there is a level of potential error associated with this. If you notice something incorrect e.g. lesson details or account details, it is not meant offensively. In these cases please let us know so we can rectify the situation as soon as possible.
3.Timetabling of Lessons
3a. The student/parent will be informed of the lesson day, time, and the date of their first lesson before their teaching commences, either by phone, in person or by email. Gifted Youth will aim to confirm all the lesson details by email, but does not guarantee that this will be the case if it deems sufficient confirmation has been provided by other means.
3b. Site-based lessons - if the agreed lesson times or days need to be changed, the student and or parent will be contacted as far in advance as possible and alternative arrangements will be made to continue the lessons at times and days that suit the student and Gifted Youth
4. Absences
18 hours’ notice is given for missing a lesson no catch-up lesson or credit will be given. This lesson is considered forfeited.
4.a.iii. Where at least 18 notice of the intended absence is given, this is deemed an “explained absence.”
4.a.iv. Your or your child’s tutor will arrange a replacement/catch-up lessons for up to two lessons per 90 days for explained absences with you at a mutually agreeable time.Your or your child’s tutor will arrange a replacement/catch-up lessons for up to two lessons per term for explained absences with you at a mutually agreeable time. THIS WILL BE DONE THROUGH OPUS, NO OTHER WAY OF RESCHEDULING LESSONS IS SUFFICIENT UNLESS GIVEN PERMISSION BY OUR STAFF. They can cancel their lesson within the online portal on opus 1. They will be prompted with instructions to reschedule their lesson.
4.a.v. Gifted Youth’s tutors are trained to go above and beyond to help work these replacement/catch up lesson timings out with you, however, If you decide that you would prefer to not have this, this lesson is considered forfeited. Please note the responsibility is on the caregiver/parent to jointly work with their tutor to find a mutually beneficial time. The tutors are instructed to diligently help in this so please let the main office know if you feel this is not happening.
4.a.vi. It is only by managerial discretion that customer credit is placed on a pupils account to the value of a missed lesson. Customer credit is not transferable for money but will be used at the earliest convenience - usually the next term’s fees.
5. Due to the nature of Group Lessons they can not be made up
Unavoidable cancellations – If Gifted Youth cancels any lessons due to events out of its control, customer credit may be given at the discretion of Gifted Youth’s management
6. Canceling the Lesson Agreement – the student must opt out of the Lesson Agreement with Gifted Youth
6a. If the student and or parents wish to cancel lessons with Gifted Youth, an email must be received and they must give Gifted Youth a 30 days notice. Any payment already made already will not be refunded
6b. Verbal notice given to the tutor will not be acted upon and is not considered sufficient unless confirmed by email by Gifted Youth
6c. Exceptions on medical grounds may be made to this as decided by Gifted Youth
6d. If Gifted Youth has to cancel a lesson agreement it will endeavor to give two weeks’ notice to the pupil. Any lessons remaining after the lessons’ end date will be credited to the pupil's account if payment has already been made.
6e. If, in exceptional circumstances, Gifted Youth has to cancel the pupil's lesson due to damage of Gifted Youth’s property or harassment of The Gifted Youth’s staff by the pupil, this may be done with no notice and no credit or refund for any outstanding lessons.
7. Photography & Filming
7a. Gifted Youth may use film or still photographs of students for appropriate promotional purposes.
7b. You (or your parents if you are under 18 years of age) must inform Gifted Youth in writing at any time if you will not allow the use of such images.
8. Changes to the Terms and Conditions
8a. The Terms and Conditions described above are agreed to upon enrollment and may be changed at any point by Gifted Youth without providing notice to the student. A copy of the Terms and Conditions will always be available on our website and may be emailed to the student and or parent on request.
9. Medical Release
9a. Unless written notice is given to the studio, permission is granted to Gifted Youth and its operators to seek medical treatment for the participant in the event they are not able to reach a parent or guardian. Parent/Guardian must also submit written notice for any physical/mental problems, restrictions, or conditions.
10. Liability
10a. Parents, legal guardians of minor students, and adult students fully waive and relinquish any and all claims against Gifted Youth and its owners, teachers, officers, agents, and employees from illnesses, injuries, or damages as a result of participating in any activities or classes in any way associated with Gifted Youth. I further agree to indemnify and hold harmless Gifted Youth from any and all claims resulting in illnesses (including but not limited to COVID-19), injuries, damages arising out of, connected with, or in any way associated with the activities of any of the programs.
